The Federal DOL's standard for "who" is considered an employee vs. an independent contractor has officially changed in January 2024. It all comes down to the nature of your relationship(s) with each of these individuals or groups of workers- and the nuance being utilized in "testing" these relationships is more subjective than ever. Bottom line? You NEED to review all such relationships you have in your business to make sure you are in good shape should these be challenged- at a time when enforcement is expected to be greater than ever.
