<image:title>Resources - Hiring Family vs. Employees: Facts vs. Misconceptions for NYS Employers - Hiring family into a business often feels informal — but under New York State labor law, family members are employees unless a very narrow exception applies. Most employers are surprised to learn that NYS does not offer broad exemptions for family labor like some other states or federal agricultural rules.</image:title>

<image:title>Resources - Your 2025 Year-End HR Checklist - While 2025 may have been quieter on the regulatory front compared to the post-COVID years that preceded it, employers should not mistake “quiet” for “inactive.” Several key updates still require attention — and there are additional, strategic steps every employer should take as we head into 2026.</image:title>
<image:caption>Below is a concise list of the required updates, along with recommended best-practice actions to help you stay compliant, reduce risk, and get ahead of the growing employee expectations around flexibility, workplace exceptions, and overall work-life balance.</image:caption>

<image:title>Resources - What New York Employers Need to Know About the 2026 NYS Retirement Plan Requirement - If you employ people in New York State, a major compliance deadline is on your horizon. Beginning in 2026, the New York Secure Choice Savings Program (“Secure Choice”) becomes mandatory for many employers who do not already offer a retirement plan- but also requires actions by those that do. And while the rule is straightforward, the details matter — because missing the deadlines will put employers at risk for penalties and corrective actions.</image:title>

<image:title>Resources - No Tax on Tips Act — An Employer’s Guide - What This Means</image:title>
<image:caption>Congress has passed the No Tax on Tips Act, giving eligible tipped employees a major new tax break. Reported cash tips (including credit card tips and tips shared under valid tip pools) will now be tax-deductible for employees. Employees won’t see bigger paychecks during the year (normal payroll withholding still applies). Instead, they’ll see the benefit when they file their federal tax return — either a lower tax bill or a larger refund. For most employees in a ~22% tax bracket, this could mean thousands of dollars back that used to go straight to the IRS. This applies even to positions not typically regulated under tip wage rules- including many outside of service and hospitality, so even if you are an employer not in these industries, this could apply to your employees if they accept tips.</image:caption>

<image:title>Resources - How to Conduct an I-9 Audit - With immigration in the spotlight nationally, it is widely expected that I-9 audits will sharply increase this year as the Department of Homeland Security and related agencies take a broad approach to identify illegal immigrants and workers. With this in mind, regardless of industry, size, or location, employers would be wise to take this opportunity to audit not only their I-9s practices (including completion at hire, storage, etc.) but also their current I-9 records. When audited, if I-9s are found to be missing, incomplete, or even completed with minor errors, the potential exists of big fines and penalties to be levied.</image:title>
<image:caption>With all this in mind, below we break down general guidance on how to conduct an audit of your I-9s ASAP, as well as compliant I-9 practices to implement should you find your not quite right.</image:caption>

<image:title>Resources - Why Unemployment Claims Matter - Do you fight unemployment claims made against your business?</image:title>
<image:caption>So often we come across employers who don't bother to respond to unemployment claims made by ineligible employees. The main reasons are either time (this is just one more admin task there is just no time for), a feeling of being powerless (unemployment will be rewarded no matter what anyway), or just being totally unaware of the consequences of a single claim (it doesn't really matter for anything, so who cares?). But the truth is, it is possible to contest claims, it doesn’t take that much time if you prepare ahead, and the implications of not doing so can mean a significant financial difference to your business.</image:caption>

<image:title>Resources - Employer Alert: Understanding Employee Retaliation Protections - Retaliation has been the most common type of EEOC charge for five years, included in more than 50 percent of all charges filed by employees nationally since 2018. Retaliation claims have also been explicitly stated to be an "enforcement priority" by the EEOC, as well as other employer-protection agencies in the coming years, which means charges will only be increasing.</image:title>
<image:caption>With all this in mind, employers are wise to become educated on the definition, scope, and best practices surrounding retaliation, including how to keep it out of your business, both from an actual and perceived perspective.</image:caption>

<image:title>Resources - Unionization: What Employers should know & do to be pro-active against increased efforts. - With unionization efforts on the rise, employers are increasingly finding themselves in the difficult situation of having to navigate these uncertain and often contentious situations with their staff. Of course, the best defense against such a possibility is an even better offense, and all employers can best prepare themselves against these efforts by putting their business in the situation where staff does not feel the need to unionize to begin with. Nonetheless, even in situations where the best attempts are made to do the right things, there is no guarantee that such activity won’t present itself in your workplace. When this happens, how you respond is critical to the overall outcome, but also in determining whether you inadvertently get yourself into more trouble.</image:title>
<image:caption>To help prepare you for a situation like this, we’ve assembled an introduction to all-things unionization, including an overview of employee and employer rights, and best practice tips for preventing and responding to a campaign inside your business.</image:caption>

<image:title>Resources - Employers’ Obligations for Accommodation - Under the Americans with Disabilities Act, and an accompanying web of other laws and protections at both the state and federal level, nearly all employers have some obligation to “accommodate” or modify otherwise usual aspects of performing in a role, to remove barriers to employment for individuals with disabilities. The scope of an employer’s obligation to accommodate is often not fully understood. In addition, the process of understanding where and when this is required, and how to go about meeting this obligation in the best way possible for both the business and the employee, can be tricky and fraught with opportunities for missteps.</image:title>
<image:caption>To help make this process easier, we’ve put together an easy guide below on what your obligations are, and how to meet them, for the benefit of your staff and your business.</image:caption>

<image:title>Resources - Under Pressure: Tips for employers when considering increasing employee pay. - More than ever, the pressure is on for employers to be sufficiently compensating employees. Between rising living costs, talent scarcities and competition, and a heightened narrative on equity, the mounting reasons businesses are being bombarded with to raise pay can be overwhelming. Under such stress it can be easy to react and make decisions in efforts to move the needle or avoid issues, but like most situations, taking action out of duress or desperation is probably not a good move.</image:title>

<image:title>Resources - Top 5 Wage & Hour Compliance Essentials in 2022 - In the past five years, the US Department of Labor has collected over $1.4 billion in back due wages from employers across the Country. The audits conducted by the DOL to uncover these wages result from a combination of complaints made by disgruntled employees, but also random audit activity- which is explicitly set to increase in this new administration. If there is one area of employment law that employers certainly cannot afford to be anything but compliance, it is wage and hour practices- that’s all-things time and pay related when it comes to employees.</image:title>
<image:caption>This law can be very nuanced based on specific employer-situations, but to get you started, we’ve put together a list of the top 5 areas of concern on this topic, which are also the top areas where employers most-commonly end up paying big when audits or claims do occur.</image:caption>

<image:title>Resources - The Forgotten Managers: The Real MVPs of Your Business</image:title>
<image:caption>The stress test of COVID has thrust multiple areas of our society into the spotlight as unique challenges have exposed multiple areas of vulnerability across all aspects of life. One such area has certainly been the employment world, with businesses experiencing wild fluctuations in business activity and requirements, causing similarly extreme fluctuations in employment levels. All of this has prompted conversations about wages and conditions for workers- especially focused on hourly staff. Although this has been the case, arguably there is an overlooked group within this conversation, and that is Managers. Whether you call them Leads, Supervisors, or something else, one could argue that in the past year and a half, the direct people-leaders have been the unsung heroes of business, perhaps prompting the realization that they are always the most valuable players in this space.</image:caption>

<image:title>Resources - Have Contractors instead of Employees? Make sure you know the risks and requirements. - Deciding to have an army of contractors vs. employees isn’t necessarily a business “preference” decision, but one that can have very real legal and financial implications if not made in an educated way. This is especially so as the political winds have again changed at the Federal level, which is going to make this subject less favorable and more risk-prone for businesses, as the Biden administration has already rolled back a more lenient Trump test for deeming a worker a “contractor” vs. “employee”.</image:title>
<image:caption>Businesses need to understand that there are standards that need to be met in order to take someone on as a contractor vs. employee, and also all the implications that come with these distinctions- including penalties if this is not done correctly.</image:caption>

<image:title>Resources - How to Save Yourself from the Turnover Tidal Wave - The big concern for employers has shifted from difficulty in attracting and hiring talent, to the unusually high, and increasing rates of loss of talent. In their fourth annual Engagement and Retention Report, Achievers Workforce Institute identified some pretty serious trends in employment, and this has also been reflected in similar data, including stats from the Bureau of Labor Statistics (BLS). Of those surveyed by Achievers, a majority 52% of respondents indicated they will actively seek a new job in 2021- that’s over half of the workforce, and BLS says this number is on trend to be the highest it’s been since 2001. The main motivators reported by those who indicated they will be seeking new opportunities include better compensation and benefits (35%), as well an improved work-life balance (25%)- all things the pandemic helped highlight the need for. By contrast, those who report they will happily be staying put, cite the already satisfactory work-life balance (23%) and a strong recognition culture (21%) as the main reasons they plan to stay put.</image:title>
<image:caption>With this information in mind, we’ve put together a short-list of actions any business can take to prepare to fight off this wave of turnover. Hint- most of it doesn’t involve you just increasing pay rates.</image:caption>

<image:title>Resources - Effective vs. Compliant Onboarding: Easy tips to starting off on the right foot with your new employees. - We’ve spent a lot of time lately talking about recruiting and hiring efforts, as just getting quality candidates to apply is hard enough these days. Hopefully this help has gotten you a few people queued up to start, so now let’s talk about some tips on getting them started in the best way possible.</image:title>
<image:caption>When it comes to onboarding, like most things HR, you can take a minimum effort approach and do just what is needed to be compliant, or you can roll out the red carpet and create a whole Company experience to welcome your new team members. Instead of telling you what to do (although we’d love to!), we instead have provided a list below of what you need to be doing, what you should be doing, and what you could be doing when onboarding your newbies. From this list, you can pick and choose what you want to implement to create an onboarding packet and program that works best for your business and your new hires, whether you’re using an electronic system for this process, or are still kicking it old school with paper packets.</image:caption>

<image:title>Resources - To Mask Or Not to Mask? - Both NYS and the CDC now agree that fully vaccinated individuals can resume most normal life activities without wearing a mask starting this Wednesday May 19th. OSHA has also relaxed their guidance indicating they support CDC guidance, meaning employers now have the green light to make this change in their work place. But with an issue like COVID, we all know that the simple facts on the surface are far from all the information that needs to be considered- especially when factors like emotion and politics are still strongly in play.</image:title>
<image:caption>As you consider whether to roll back the mask mandate for vaccinated individuals in your business, we strongly encourage you to consider the below points which could help you avoid secondary disruptive and costly effects to your business. <image:title>Resources - Taking Control of your Unemployment Costs - Employers across NYS, and the entire country, are unsurprisingly seeing an increase in their unemployment tax rates after a year of unprecedented claims against states’ unemployment funds. Although some states are electing to exempt COVID-related unemployment claims from affecting employer’’ rates, NYS is not opting for this method. This means, every employer in NYS can expect to see an increase in their rate following the pandemic- and probably already have.</image:title>
<image:caption>Although an increase is inevitable, there are actions that employers can be taking now and moving forward to ensure that their own rate is kept to a minimum, and at a time when every penny counts for a business, we encourage you to take these easy steps to keep your rate as low as possible.</image:caption>

<image:title>Resources - 5 Lessons Businesses Need to Learn from the Pandemic</image:title>
<image:caption>This past year has been incredibly difficult for everyone. But as we move toward “normal” and begin to reach the other side, there is undeniable value to be taken away from the hard lessons that COVID taught us- many we may not have learned if not forced to do so. We’ve put together our top 5 take-aways we think every business needs to come out with, or risk missing the opportunity within this tragedy.</image:caption>

<image:title>Resources - Opportunities with your hourly hiring that you’re totally missing out on.</image:title>
<image:caption>Many employers who have hourly staff are feeling the squeeze right now as the economy opens and businesses need staff to resume to more normal levels of operation, while at the same time employees seem less motivated to work than ever. This has left employers scratching their heads about what they can do to find and hire needed staff. Obviously making sure your jobs are visible on the most popular websites is essential in this endeavor, but in addition to waiting for people to apply, there are other more pro-active measures you may want to consider taking to address this problem. Bottom line- the time to think outside the box is here. We’ve put together some tips on how you can do this, and maximize the benefit to your business.</image:caption>

<image:title>Resources - Making Your Own Luck: Finding and Hiring the Right Person (the first time), like your Business Depends on it (spoiler alert, it does) - Luck is what happens when preparation meets opportunity.</image:title>
<image:caption>After a recent “feel good” success story filling a new, key role for their growing operation, one of our clients was feeling pretty “lucky” about finding their first Client Success Manager. This candidate checks all the boxes: he’s got the skills and experience we were seeking to add to the business, but even more excitingly, he is a great culture-fit-addition to the team. But although this endeavor was leaving us feeling super fortunate about finding our guy, was it really sheer chance that landed us here? Heck no! Luck isn’t some happy accident; it’s the result of doing the work to put yourself in a position to have an opportunity to present itself, and all the preparation you do to be ready to recognize, seize, and make the most of that opportunity when it does come knocking. I think it’s safe to say that all businesses understand, at least to some degree, the connection between having a thriving, successful business, and having great, successful people that directly contribute to making that success happen. It’s also no secret to any business owner the cost in time, productivity, and straight dollars a bad employee can have. There are a slew of statistics about the billions of dollars that are lost each year from disengaged staff nation-wide, or how replacing an employee on average costs twice as much as their annual salary. With all this being said, why is it that so many businesses, even unconsciously, rely on this idea of “luck” or chance in hiring? Just like with marketing, operations, and other components of a business, there are clear actions that businesses can take to find and hire the best people possible to then have the best impact on their business. With a little help and a lot of discipline, our client put in the work to put themselves in the position to get lucky in finding their ideal hire, and lucky for you, we’re here to share some tips on how you can do the same.</image:caption>
